Understanding the Florida Quitclaim Deed

A free, plain-English overview of what a quitclaim deed does, when it is used, and its tax and title consequences.

What’s in the guide

A quitclaim deed transfers whatever interest the grantor has in a property, if any, with no promise about the title. In Florida it must be signed in front of two witnesses and notarized before it can be recorded, and documentary stamp tax can be due even when no money changes hands if the property has a mortgage.

This guide covers when quitclaim deeds are commonly used, how co-owners hold title, recording, documentary stamp tax, homestead and spousal joinder, property tax and Save Our Homes, the mortgage due-on-sale clause, and common mistakes. It links to the Florida Statutes and Administrative Code so you can read the sources yourself.
