Free reportWill vs Trust in Florida: The Basics
Planning ahead is one of the kindest things you can do for your family. Here are the basics, in plain English.
Peace of mind is closer than you think
Many people put off estate paperwork because it feels overwhelming. It does not have to be. Knowing the basic difference between a will and a trust is a great first step.
A will, in general
A will says who receives your property and who handles your estate. In Florida a will must be signed at the end in front of two witnesses, who also sign. Property passing under a will generally goes through probate.
A revocable trust, in general
A revocable living trust holds property you put into it during your life and can pass that property after death, generally without probate for the assets in the trust. In Florida, the after-death parts of a revocable trust must be signed with the same formalities as a will.
