Understanding the Florida Health Care Surrogate and Living Will

A free, plain-English overview of Florida’s two main health care advance directives.

What’s in the guide

A Designation of Health Care Surrogate names the person who makes health care decisions for you when you can’t. A Living Will states your own wishes about life-prolonging procedures if you have an end-stage or terminal condition or are in a persistent vegetative state. Both fall under Chapter 765 of the Florida Statutes and cover health care only.

This guide also covers what happens without these documents, HIPAA privacy, anatomical gifts, and how they differ from a Do Not Resuscitate Order, with links to the statutes so you can read the sources yourself.
