Understanding the Florida Living Will

A free, plain-English overview of the Florida living will and how it works with a health care surrogate.

What’s in the guide

A living will is a written declaration stating, in advance, whether life-prolonging procedures should be provided, withheld, or withdrawn if you have a terminal condition or an end-stage condition, or are in a persistent vegetative state. In Florida it must be signed in front of two adult witnesses, and at least one of them must be neither your spouse nor a blood relative.

This guide explains how a living will is carried out, how it relates to a health care surrogate, what happens without one, how to change or revoke it, and how it differs from a Do Not Resuscitate Order. It links to Chapter 765 of the Florida Statutes so you can read the sources yourself.
