The Florida Uncontested Divorce Guide

A free, plain-English guide to simplified and uncontested divorce (dissolution of marriage) in Florida.

What’s in the guide

In Florida, a divorce is formally called a dissolution of marriage, and every one goes through the circuit court. A divorce is uncontested when both spouses agree on everything the judge would otherwise decide: how property and debts are divided, alimony, and, if there are children, the parenting plan and child support.

This guide walks through the two uncontested paths (the Simplified Dissolution and a regular dissolution filed on an uncontested basis), residency, the 20-day waiting period, and the Florida Supreme Court approved forms. It links to Chapter 61 of the Florida Statutes and the court rules so you can read the sources yourself.

Free Florida Divorce Monthly Expense Worksheet

A free worksheet you fill out on your own to organize your monthly income and expenses before you call. Its categories follow the income, deduction, and expense headings printed on the Florida Supreme Court approved Family Law Financial Affidavit forms (Form 12.902(b) and Form 12.902(c)), so your numbers are grouped the same way. The Excel version adds everything up for you; the PDF is for printing and writing in by hand.

This worksheet is an organizing tool only. It is not a court form, it is not filed with the court, and it does not tell you which form applies to you or how to fill one out. The official forms and instructions are free at flcourts.gov.
