Understanding Florida Residential Leases and Eviction Notices

A free, plain-English overview of the Florida Residential Landlord and Tenant Act for landlords and tenants.

What’s in the guide

Residential rentals in Florida are governed by Part II of Chapter 83 of the Florida Statutes. The Act sets the rules for leases, security deposits, notice periods, and the written notices a landlord must deliver before filing an eviction, and a lease cannot take away the rights it gives either side.

This guide covers what a lease typically addresses, security deposit rules, ending a tenancy that has no fixed term, the 3-day and 7-day notices, the eviction case step by step, and why self-help eviction is prohibited. It links to the Florida Statutes and the Florida Supreme Court approved landlord-tenant forms so you can read the sources yourself.
